New Delhi : The Government of India prepared the Constitution 124 Amendment Bill, 2019 to further amend the Constitution of India by adding Clauses 15(6) and 16(6) for providing reservations in the educational institutions and for the appointment of posts in favour of economically weaker sections other than the SCs, STs and Backward Classes on 7th January. The Bill was passed in the Lok Sabha on 8th of January and in the Rajya Sabha on 9th.

Today, Justice V. Eswaraiah addressed a conference regarding the issue in the National Capital.

The National Backward Classes Federation has taken up this issue effectively exposing the illegality and the high handed action of the Government of India in hastily amending the Constitution, hurriedly keeping in view of the ensuing elections 2019.

The said Constitution Amendment Act is against the preamble, equality, social justice, basic structure of the Constitution and the Judgements of the Supreme Court.

As per the preamble to do the social justice for socially discriminated, oppressed, depressed, exploited, suppressed classes and to bring them on par with the general classes/castes of the people there can be reservations in the educational institutions and for the employment.

Speaking at the session, Justice V. Eswaraiah said,

“The economic justice doesn’t mean that there shall be reservations in the educational institutions and employment to the upper classes/ruling classes. The Constitution does not enable for such reservations to economically weaker sections.”

“Under Article 38 of the Directive principles, the State shall strive to promote the welfare of thepeople by securing and protecting the social order i.e., the social, economic and political justice in all the institutions of the national life. The state shall strive to minimize the inequalities in income, eliminate inequalities in status, facilities and opportunities and also among the people residing in different areas or engaged in different vocations. The other directive principles such as achieve equality, equal status, equal pay for equal work, not to abuse the women, children, weaker sections are all with regard to social justice”, he added while addressing media after the discussion.
