Impeachment Motion: Congress cites rejection illegal, BJP says Opposition trying to defame judiciary

New Delhi: The rejection of impeachment motion of Chief Justice of India (CJI) by the Vice President and Chairman of the Rajya Sabha M Venkaiah Naidu has triggered a political storm in the country.
Ruling BJP and Congress leaders have locked horn over the issue and both parties have been alleging each other that they want to save the judiciary and democracy which are under threat.

On Monday morning, Vice President M Venkaiah Naidu has rejected the impeachment motion application signed by the 70 Rajya Sabha MPs of six different parties including Congress against CJI, Deepak Misra saying that the application was baseless.
As the news of rejection flashed in the media, Congress leaders launched attack on BJP and also questioned the intention of VP of rejecting the impeachment motion.
While addressing a press conference at Delhi party office, veteran Congress leader and senior lawyer of the Supreme Court Kapil Sibal termed the move unprecedented, illegal, ill-advised and taken up in hasty.
“This is unprecedented because first time in the history of India, any impeachment motion rejected at first stage despite having clear majority votes for the motion and evidences.” Sibal said adding that the move is illegal because he has no right to reject as per the law, he has only right to look that the motion qualifies Article 124 of the Indian Constitution.
He further said that the decision has taken in hasty and BJP government is keen to reject this motion because they are in fear, if this impeachment motion initiated and probe launched then the government would have face criticism and may affect the upcoming election result. “BJP don’t want this probe because four Supreme Court judges have already leveled charges that Judiciary is in threat under CJI Dipak Misra and if the probe initiated then it will prove that four judges were right.”
Later he said, Congress will move Apex court to challenge VP’s decision.

Hitting back to the Congress, BJP MP and nation spokesperson Meenakashi Lekhi lambasted the grand old party and said from last few years Congress is attacking and disrupting constitutional institutions like the Parliament, Judiciary and “We have to save the both.”
Citing VP’s M Venkaiah Naidu move accurate she attacked Congress. “Without having any evidences they are trying to impeach a CJI and VP has rejected the motion after taking proper suggestions and checking all the facts.”
She further said, “When Congress was in power, they widely misuse the power to gain political benefits and now those cases are proving false Congress is trying to create anarchy, so, the people loss their faith on judiciary.”
