This is what eminent law experts said on apex court’s order to indefinitely extend Aadhar linking:

Supreme Court on Tuesday granted a major relief to many by extending date of linking Aadhar by Bank accounts for an indefinite period. Ten News reached out to esteemed advocates to know their views on this significant court order.

“SC decision should be welcomed in the light of no clear direction for mandating Aadhaar. I feel after SC decides in issues involving Aadhaar it would be wise by Government to think of linking and how to do it , for whom it should be made compulsory etc,” said Advocate Prashant Mali, Cyber Law and Cyber Security Expert.

Another renowned advocate Amit Khemka provided a more detailed analogy of the SC order and presented his view.

He said, “There cannot be any doubt that rather than having multiple IDs such as Election Card, Ration Card, Diving Licence, PAN card and so on, it is much better to have one ID and all these things can be related. But there are only two questions according to me. First is safety. Everyone knows that Aadhar Data is easily available and as such nowadays even the finger print impressions and iris imprint can also be copied. As such the whole existence of an individual is threatened. Some one having access to this humongous data can create havoc. It can actually be a very big tool in the hands of cyber terrorists. If we wish to implement it, we have to iron out all such concerns. The problem can’t be solved just by denials. The system has to be made absolutely safe before making it mandatory”.

He also added his concerns about the citizen privacy and said, “Second issue is that of privacy and Government knowing a little too much about people can be very dangerous”.

Advocate D.K . Mangal also expressed his pleasure over the step and said, “It is welcome step taken by hon’ble supreme  court , as haste in this matter will create unnecessary hardships for common man . I personally don’t oppose the linking but the coordination among various service providers and government agencies is very poor. Once a pan is linked with Aadhar what is the need to link various investment accounts with Aadhaar again as all investments are already linked with pan , there is definitely lack of sense it the same”.

By extending date for updation of Aadhar Card till the verdict of Apex Court is pronounced is an appropriate decision by the Court. Maybe Court passes final order which may have some rider” said Advocate K M KAPOOR

Advocate Preeti Sirohi ,”It’s a big relief to people, specially to those who due to their busy schedule were not able to do the same & also relief to the banks as they can peacefully carry on with the closing of the financial year and not becoming jumping jacks from the balance sheet folder to adhaar linking folder. A good interim relief for all”.

Apart from renowned advocates, even most common citizens wholeheartedly welcomed SC decision and appreciated the relief. Regular calls and messages by banks and other service providers for linking of Aadhar had become a nuisance for many citizens who were very relieved after the order of the Apex court.
