SC extends STAY for PGDM Institutions for Admissions in the academic session year 2018-19

Long pending legal matter of 350+ PGDM institutions pertaining to the withdrawal of the autonomy enjoyed by these b’schools since 60’s, has come up before the Hon’ble Supreme Court of India today.  In December 2010, the AICTE has issued an order by which autonomy of PGDM  institutions (Self finance autonomous) in respect of admissions, fee fixation, curriculum and examination matters was withdrawn.  After lot of persuation with the MHRD and the AICTE, the EPSI had to file a Writ Petition (92/2011) in the Hon’ble Supreme Court of India.  During the last seven years, the Apex Court has stayed the AICTE’s Notification five times in favor of PGDM institutuions.

The Writ Petition (C) No.92 of 2011 filed by the Education Promotion Society for India (EPSI) came up for hering today i.e. on 20th November, 2017 before the bench comprising of the JUSTICE S.A. BOBDE and JUSTICE MOHAN M. SHANTANAGOUDAR.

The matter was heard by the bench and the Hon’ble Court has extended the stay dated March 17, 2011 for the Academic Session Year 2018-19 also. The PGDM Institutions for the academic session 2018-19 will continue to take admissions through six national tests viz., CAT, XAT, MAT, ATMA, GMAT and CMAT.  Further, the Hon’ble Suprme Court ordered to hear the matter regularly to pass a final order. 

Dr. H Chaturvedi, Alternate President, EPSI & Director, BIMTECH, Greater Noida has said that the Hon’ble Supreme Court has once again endorsed the plea of PGDM institutions that the autonomy of PGDM institutions is vitally important for the future growth trajectory of Indian economy and the AICTE should refrain from trampling it.  EPSI is in touch with the Chairman, AICTE who is trying to resolve it amicably.  Since it is taking time, we have to go to the Supreme Court.  Now with the order of the Apex Court, cloud of suspicion on PGDM admissions for the next year are clear and we can go ahead for conducting GD/Interviews.

Dr. Chaturvedi also said that we shall continue to pursue both the MHRD and the AICTE for an amicable settlement based on mutual trust and understanding.   We are confident that the policy makers will understand our point-of-view.  Our only request to them is to allow us to work in such a way that we are able to compete globally and make India-A Hub for MBA Education.
