Delhi High Court convicts AAP MLAs on rioting charges

Delhi, Sept 13th, 2022: The Delhi High Court on Tuesday convicted two Aam Aadmi Party(AAP) MLAs for being part of a mob that allegedly attacked policemen at the Burai Police Station of North Delhi in 2015.

AAP MLAs Akhilesh Pati Tripathi and Sanjeev Jha are among the 15 others convicted in the rioting case.

They were found guilty of offences under Sections 147 (rioting), 186 (obstructing public servant in discharge of public functions), 332 (voluntarily causing hurt to deter public servant from his duty), and 149 (every member of unlawful assembly guilty of offense committed in the prosecution of common object) of IPC.

The court will pronounce the quantum of sentence on September 21, where they are likely to get a maximum three-year jail term.

During the hearing, Justice Vaibhav Mehta also held that both the AAP MLAs were also part of the unlawful assembly which had obstructed the police personnel from doing their duties.

In the judgment passed by Mehta, it said “This court is of the view that the prosecution has been able to prove beyond doubt that Sanjeev Jha and Akhilesh Pati Tripathi were part of the unlawful assembly and were part of the mob”.

Akhilesh Pati Tripathi is an MLA from the Model Town constituency whereas Sanjeev Jha represents the Burai constituency.
