New Delhi: In the last six months of his tenure, Chief Justice of India D.Y. Chandrachud faced intra-court differences, an upset legal community, and widespread criticism of his public statements, resulting in a subdued departure from the judiciary despite an initially promising start.
Now, in a stinging letter dated November 14, former Supreme Court Bar Association (SCBA) president and senior advocate Dr. Adish C. Aggarwala has criticized the retired CJI, marking this as his second such correspondence this month. Aggarwala alleged that Chandrachud’s tenure was characterized by “appeasement and publicity at the cost of others,” and accused him of undue involvement in bar politics.
The letter was prompted by Justice Chandrachud’s reflective remarks on his legacy during a convocation at JSW Law School in Bhutan. Aggarwala provided detailed accounts of administrative decisions, interpersonal disputes, and perceived lapses during Chandrachud’s time as CJI, arguing that these undermined his potential as a transformative leader.
Aggarwala highlighted controversies surrounding case allocations, including alleged political sensitivities, and the principle of the CJI being the “master of the roster,” which Chandrachud reportedly sought to defend publicly. Aggarwala also criticized delays and inconsistencies in the designation of Senior Advocates, attributing these to Chandrachud’s administrative approach, which, he claimed, led to public backlash and institutional discord.
Further, Aggarwala accused the former CJI of prioritizing public appearances and personal visibility over judicial responsibilities. He cited instances such as the missed farewell ceremony of Justice S. Ravindra Bhat, following disagreements over judgments on same-sex marriage and adoption rights.
The letter also alleged that Chandrachud sidelined acknowledgments of key stakeholders, including Prime Minister Narendra Modi, in speeches celebrating judicial technological advancements, suggesting a self-centered approach to leadership.
Aggarwala concluded by stating that while Chandrachud had the potential to leave a transformative legacy, his tenure was marred by controversies, administrative missteps, and personal priorities, leaving a mixed legacy.
These criticisms add to the ongoing debate over the complexities of judicial leadership and the legacy of Justice D.Y. Chandrachud in Indian jurisprudence.
