26/11 accused Rana challenges extradition order to India

Washington D.C., 02nd June 2023: Pakistani-origin Canadian businessman Tahawwur Rana has challenged the US court verdict allowing him to be extradited to India.

Rana has filed a habeas corpus challenging a recent US court order over claims that it would vioklate the United States-India extradition treaty in two respects. The writ petitioned filed also acts as a writ of inquiry, issued to test the reasons or grounds for restraint and detention.

Rana has been tried and acquitted, on charges based on the same conduct for which India intends to prosecute him in the United States District Court for the Northern District of Illinois. Therefore, it violates the treaty section that states extradition shall not be ‘granted when the person sought has been convicted or acquitted in the Requested State for the offence for which extradition is requested.’

The accused is wanted in India for his role in the 2008 Mumbai Taj terror attacks. He is currently detained in the Metropolitan Detention Center in Los Angeles, and was arrested by the US authorities on the same extradition request by India for his role in these attacks.
