Aam Aadmi Party reaction on the Delhi High Court judgment on Government of India Vs Delhi government case :
The Aam Aadmi Party disagrees with the erroneous interpretation of the Constitution of India done by the hon’ble Delhi High Court in this case .
The party is of the view that the Delhi Government should take this disagreement to the Supreme Court’s door, which is the only competent authority to settle dispute on the issue of distribution of powers between the state and the Centre.
While the BJP and vested interests in media are dubbing the High Court judgement as a jolt to the Aam Aadmi Party government, the AAP believes that the erroneous interpretation of the Constitution is a big jolt to the common man of Delhi, and the party will take the fight to the top court of the country.
The 69th amendment to the Constitution makes it clear that Delhi enjoys a special status and 239AA inserted in the Constitution made a provision for the legislative assembly in the National Capital Territory of Delhi.
Therefore, terming Delhi as a simple Union Territory is travesty of justice. The GNCTD Act and the Transaction of Business Rules have clearly laid down the separation of powers between the elected government and the Lieutenant Governor of Delhi.
National Spokesperson of the party Ashutosh said :”We respect the High Court but the judgement is erroneous. It goes against the spirit of our Constitution. People of Delhi have elected MLAs and not the LG. The LG is not accountable to the people of Delhi. While deciding this case, the Supreme Court will have to decide as to whom can the common man of Delhi can approach in case of a problem, their MLA and elected representatives or the LG. “Who will be accountable to the people of Delhi, the Chief Minister or the LG. What is the use of Delhi Assembly and an elected Government in Delhi, if Delhi is to be run by the LG as its Administrator? Direct election of public representatives forms the basis of Indian democracy, but after today’s judgement it seems elections are an exercise of no consequence in Delhi. The Supreme Court will have to deal with all these questions,” Ashutosh said.
Ashutosh also pointed out how today’s judgement has come as a big jolt to the common man of Delhi. He said Delhi Government’s decision to constitute an inquiry commission to probe CNG Fitness Scam has been set aside. It has only helped the accused in the case including the LG himself and former Chief Minister Sheila Dixit.
The judgement has also shrunk the jurisdiction of the ACB, which is a breather to the corrupt politicians and businessmen facing prosecution.
