New Delhi, August 12, 2023: Expressing deep concern over recent incidents of firing within court premises, the Supreme Court has issued a series of directions to ensure the safety and security of judges, court staff, litigants, and the public.
The Court instructed all high courts to formulate security plans for court buildings, including the installation of CCTV cameras and digitization measures to reduce overcrowding. This comes in response to a contempt petition filed by Pradyuman Bisht, highlighting the non-compliance of states with previous orders to install CCTV cameras.
The apex court emphasized the importance of stakeholder safety in the judicial process, stating, “safety and security of stakeholders in the judicial process is non-negotiable.” The Court recognized that firing incidents in court premises pose significant risks and could undermine public faith in the judiciary.
The directive encompasses the installation of CCTV cameras, audio-visual recording of evidence, and tighter security at entry and exit points. The Court also advised establishing a permanent Court Security Unit with armed/unarmed personnel and a supervisory officer, along with measures to address data privacy concerns.
High courts are required to draft guidelines in consultation with state home departments and police chiefs, ensuring timely implementation. Emergency services such as ambulances and firefighting facilities within court complexes must also be arranged.
The Court’s order aims to enhance court security through multi-faceted measures, taking into account the recommendations of amicus curiae Sidharth Luthra. The Supreme Court’s directive will be shared with chief justices of all high courts, empowering them to address the concerns through State Court Management Systems committees or specially constituted committees.
High courts have been instructed to submit preliminary action taken reports by October 10, providing updates on security measures and digitization. This marks a significant step toward ensuring the safety and efficiency of the judicial system across the country.
