Lok Sabha Speaker Rejects Motion Seeking Removal of Chief Election Commissioner Gyanesh Kumar

Greater Noida News (07/04/2026): The Speaker of the Lok Sabha has declined to admit a motion seeking the removal of Gyanesh Kumar from the post of Chief Election Commissioner (CEC). According to an official communication issued by the Lok Sabha Secretariat, a notice of motion dated March 12, 2026, signed by 130 Members of Parliament (MPs), had been submitted to the Speaker requesting the removal of Gyanesh Kumar from office. The motion was moved under Article 324(5) of the Constitution of India, read along with Article 124(4) and other relevant statutory provisions.

The notice also invoked provisions of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, as well as the Judges (Inquiry) Act, 1968, which outline procedures for inquiries and removal processes involving constitutional authorities.

After reviewing the notice and examining the issues raised in it, the Speaker conducted what officials described as a careful and objective assessment of all relevant aspects related to the motion. Following this evaluation, the Speaker exercised the authority granted under Section 3 of the Judges (Inquiry) Act, 1968 and decided not to admit the motion.

With the motion not being admitted, the proposed process to initiate an inquiry into the conduct of the Chief Election Commissioner will not move forward in Parliament at this stage. The decision was formally communicated through a notification issued by Utpal Kumar Singh, Secretary-General of the Lok Sabha, informing members about the Speaker’s ruling on the matter.

The development highlights the procedural safeguards built into India’s constitutional framework regarding the removal of high constitutional functionaries, including members of the Election Commission, where strict legal and parliamentary standards apply before any inquiry or removal process can be initiated.
