GSTAT Appeal Deadline Extended to July 31 After Delhi High Court Takes Up Portal Glitch Plea

New Delhi News (30/06/2026): In a significant relief for taxpayers across the country, the Government of India has extended the deadline for filing appeals and applications before the Goods and Services Tax Appellate Tribunal (GSTAT) to July 31, 2026. The decision comes amid widespread complaints of technical failures on the GSTAT portal and follows judicial intervention by the Delhi High Court.

The extension was notified by the Ministry of Finance, Department of Revenue, through a Gazette Notification dated June 30, 2026, replacing its earlier notification of September 17, 2025, which had fixed June 30, 2026, as the final date for filing appeals before the Tribunal.

The move assumes particular significance as taxpayers and tax professionals had been facing persistent technical glitches on the GSTAT portal, making it difficult—and in many cases impossible—to file appeals within the prescribed statutory time limit.

Bar Association Moves Delhi High Court

Concerned over the non-functional portal and the resulting impact on taxpayers’ legal rights, the GST Appellate Tribunal Bar Association approached the Delhi High Court by filing Writ Petition (Civil) No. 8325/2026, titled GST Appellate Tribunal Bar Association vs. Union of India.

Appearing on behalf of the Bar Association, Advocate M.P. Rastogi brought to the Court’s attention the numerous technical issues encountered by appellants while attempting to file appeals through the GSTAT portal. The petition highlighted that these system failures were preventing genuine litigants from exercising their statutory right to appeal. The matter was filed before the Delhi High Court on behalf of the GSTAT Bar Association by Advocate Ram Naresh, along with Advocates Kaushik, Shivam Malik, and S. Malhotra.

Delhi High Court Issues Notice

Taking note of the concerns raised in the petition, a Division Bench comprising Justice Mini Pushkarna and Justice Vinod Kumar issued notices to the Union of India and the Central Board of Indirect Taxes and Customs (CBIC).

In its order dated June 24, 2026, the Court directed the respondents to file their replies within two weeks, with the petitioner permitted to submit a rejoinder thereafter. The matter has been listed for further hearing before the roster bench on July 27, 2026. The Court also directed the petitioner to file an amended memo of parties after deleting the GST Appellate Tribunal as a respondent in the case.

Government Extends Filing Deadline

During the pendency of the writ proceedings, the Ministry of Finance issued a fresh notification extending the deadline for filing appeals and applications before GSTAT until July 31, 2026.

Under the revised notification:

* Appeals relating to orders communicated before May 1, 2026, may now be filed up to July 31, 2026.

* For orders communicated on or after May 1, 2026, the statutory period of three months from the date of communication will continue to apply.

* Applications concerning orders passed before February 1, 2026, may also be filed up to July 31, 2026.

* Orders passed on or after February 1, 2026, will continue to be governed by the statutory six-month limitation period prescribed under Section 112(3) of the CGST Act.

Heavy Rush Triggered Portal Issues

According to the Press Information Bureau (PIB), the extension was granted after the Government received multiple representations from stakeholders regarding severe technical problems caused by an unprecedented rush on the GSTAT portal.

The Government stated that nearly 30,000 appeals were filed during the last fifteen days alone, with the portal witnessing peak daily filings of approximately 5,500 appeals. The unusually high traffic resulted in technical disruptions, affecting the timely filing of appeals by taxpayers.

Advisory to Taxpayers

The Government has advised taxpayers and tax professionals not to wait until the last date to file their appeals. Instead, they have been urged to complete the filing process well before the revised deadline to avoid last-minute congestion and technical difficulties on the GSTAT portal.
The extension is expected to provide much-needed relief to thousands of taxpayers and practitioners who were at risk of losing their statutory right to appeal due to circumstances beyond their control.
