Allahabad HC Seeks DIOS Explanation Over Noida School’s Refusal to Issue Student’s TC

Uttar Pradesh News (23/07/2026): The Allahabad High Court has taken a serious view of a case in which a private school in Greater Noida allegedly refused to issue a Transfer Certificate (TC) to a student due to unpaid tuition fees. The court has directed the District Inspector of Schools (DIOS), Gautam Buddh Nagar, to submit a personal affidavit within one week explaining the action taken on the student’s complaint.
The matter came up before Justice Vinod Diwakar, who was hearing a petition filed by Mahi Priyadarshi, a former student of Ryan International School, Noida Extension. The next hearing in the case has been scheduled for July 29 at 2:00 PM.
According to the petition, the student’s family has been facing severe financial hardship, compounded by health-related issues, making it impossible to clear the outstanding school fees. As a result, the student sought a Transfer Certificate so that she could continue her education at another institution. However, the school allegedly declined to issue the document.
After failing to obtain relief from the school, the petitioner submitted a representation on June 19 to the District Magistrate and the District Inspector of Schools (DIOS), Gautam Buddh Nagar, through registered post, requesting official intervention and directions to the school to release her Transfer Certificate. The plea, however, allegedly remained unattended.
During the proceedings, the petitioner’s counsel, Advocate Ashish Kumar Mishra, informed the High Court that despite receiving the complaint, the concerned authorities had not taken any meaningful action.
Observing the matter, the High Court noted that once a representation is received by a competent authority—particularly when supported by proof of delivery—it is expected to be considered and decided within a reasonable period. The court expressed concern over the apparent administrative inaction.
The bench has directed the DIOS to clarify through a sworn personal affidavit whether the representation was received, what steps were taken after its receipt, and the reasons for the delay in deciding the student’s request.
The case raises important questions about students’ educational rights and the responsibilities of educational institutions and government authorities in ensuring that administrative procedures do not obstruct a child’s access to continued education. The High Court is expected to examine the matter further during the next hearing on July 29.
