New Delhi (31/10/2022): Supreme Court bench comprising justices DY Chandrachud and Hima Kohli overturned a decision by the Jharkhand High Court acquiting a murder and rape convict, and upheld a trial court’s decision holding the convict guilty.
In a strong statement, the court also stated that it is unfortunate that the practice of “two-finger test” to examine rape suvivors is still prevalent in society.
The bench further said that a decade-old decision of the apex court had held the “two-finger test” as a violation of woman’s dignity and privacy.
The Supreme Court also directed the Centre and the State government authorities and asked the DGP and health secretaries of states to make sure that the “two-finger test” is not conducted.
The top court held that any individual carrying out the two-finger test will be held guilty of misconduct.
