Greater Noida Authority on Patwari and other villages land acquisition petetions in SC
“The full bench that is Gajraj had created 3 groups. (1) it dismissed the petitions of quashing of notifications of those farmers who came late to challenge on grounds of delay and latches. (2)it allowed petitions of some on the grounds that no development taken in those villages .The order of Acquisition of 3 villages Devla ,Asadullapur and Yusufpur chak shahberi alone was quashed as there was no development.(3) in this category all the other villages came . In this the full bench said (a) give 64.70% additional compensation (b) give 10% developed land instead of 5 or 6% (c) the farmers right to move DJ court under section 18 of land acquisition act 1894 will continue.” Said Greater Noida ACEO Shishir
He aslo added that “In all other villages acquisition was upheld including village Patwari. Patwari s settlement of 64.7 % addl compensation and 10% developed land formed basis of full bench directions. IMPORTANT both Gajraj and Savitri challenged acquisition in Patwari. Judgement dt 14.5.2015 was in Savitri swho challed acq. Of her land in village Patwari. ”
“Savitri in her SLP wanted quashing of acquisition of her land in vill Patwari. She prayed for return of her land. This relief was not granted by Supreme Court . Acquisition in vill Patwari stands . “Said Greater Noida ACEO Shishir
He was of the view that the judgement of Supreme Court is in no way against us. Rather it reaffirms the stand of ours. The Supreme Court has even mentioned para 45 in its judgement of clarification and disposed of the application.
