Under the leadership of BJP Delhi Pradesh President Shri Satish Upadhyay a delegation of Delhi BJP leaders met the Principal Secretary of Election Commission of India Shri K.F. Wilfred and submitted a memorandum demanding recommendation to the President of India for disqualifying 21 Aam Aadmi Party MLAs who have been appointed Parliamentary Secretaries under Delhi Government.

The delegation included Leader of the Opposition Shri Vijender Gupta, National Secretary Sardar R.P. Singh, Pradesh General Secretary Shri Ashish Sood, MLA Shri Om Prakash Sharma and Shri Jagdish Pradhan, Media Incharge Shri Praveen Shankar Kapoor & Advocate Shri Vivek Garg.

Addressing the media persons after submitting the memorandum to the Election Commission, BJP Delhi Pradesh President Shri Satish Upadhayay said that in addition to the order of allotment of rooms to 21 MLAs appointed as Parliamentary Secretaries by the Delhi Legislative Assembly we had submitted the copy of the letter issued by the Secretary to the Chief Minister before the Election Commission in which it has been clarified that these MLAs shall be provided rooms and Government vehicles. Shri Upadhyay said that in the memorandum we have pointed out that according to the provisions of the Constitution only one Parliamentary Secretary could be appointed in Union Territory of Delhi and this Secretary could be appointed only in the office of Chief Minister and hence all these appointments are unconstitutional.

Leader of the Opposition in Legislative Assembly Shri Vijender Gupta pointed out before the Election Commission that Delhi Government had tried to get a resolution passed in the last session of Legislative Assembly according to which proposal was made to amend the Constitutional provisions for the appointment of Parliamentary Secretaries with retrospective effect. This way the proposal for the amendment with retrospective confirms that the Government was well aware that these appointments are illegal.

BJP National Secretary Sardar R.P. Singh said that in similar circumstances Congress President Smt. Sonia Gandhi and Smt. Jaya Baccha had also resigned. He further said that the Delhi Government is not only violating the Constitution in the case of Parliamentary Secretaries but also violating the Model Code of Conduct issued by Election Commission which has been seen in the recently held Municipal Bye Elections. The Government violated Model Code of conduct many times during the twenty days election campaign and it issued public notification in the newspapers connected with water meters on the day of election.
