New Delhi, 13 November 2022: The Delhi High Court has ordered the discharge of a police officer who was found in possession of foreign currency in 1996 while performing a “highly sensitive function” at the Delhi airport to check passenger passports.
The HC maintained that he was expected to be the guardian of the law and must be dealt with harshly for breaking it.
It declared that there was no justification for interfering with the Central Administrative Tribunal’s decision to fire the chief constable, supported by Delhi Police’s top leadership.
The bench led by Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad, said that the police officer is supposed to be the guardian of the law, and it is their responsibility to make sure that everyone is abiding by the law. Such a person must be dealt with harshly if they break the law themselves. In light of the facts and circumstances of the case, this court thoughtfully believes that the only possible sentence for him was dismissal.
The petitioner was a head constable assigned to the Indira Gandhi International (IGI) airport’s Terminal 2 by the Delhi Police. A surprise visit to the DCP in March 1996 revealed that two police officers were taking money from passengers while they were having their passports checked.
After a search, it was discovered that the head constable had 75 dirhams in his pocket, and legal action was started against him. The fired cop contended in his defence that there was no proof of him soliciting and accepting a bribe, and that since there were no eyewitnesses or statements from the person who was reportedly the target of the extortion, it was impossible to prove any wrongdoing.
Further, the court stated that there is no evidence in the case. It stated that it was an undeniable truth that the petitioner’s possession of 75 dirhams was found during the search.
The bench stated that the officer had not offered a convincing justification for his possession of foreign currency at the time of the seizure.
