In a first, High court asks ChatGPT for opinion on Bail case, here’s what happened

New Delhi (India), 28th March 2023: The Punjab and Haryana High Court used ChatGPT to gain insight while making a decision on a bail plea, which could be a sign of how the paradigm will change in courtrooms across the nation.

Justice Anoop Chitkara tried to check the apps skills and knowledge of the bail laws that are relevant when an attacker conducts a cruel assault using the AI tool.

The chatbot ChatGPT was asked the following question, “What is the jurisprudence on bail when the assailants assaulted with cruelty?”
The chatbot answered, “The jurisprudence on bail for cases where the assailants have assaulted with cruelty will depend on the specific circumstances of the case and the laws and regulations of the jurisdiction where the case is being tried.”

Further it said, “However, in general, if the assailants have been charged with a violent crime that involves cruelty, such as murder, aggravated assault, or torture, they may be considered a danger to the community and a flight risk.”

The court had to decide whether to grant bail to the accused in a case involving an attempted murder. While reviewing bail law, the Court made the remark that while causing death is cruel in and of itself, it becomes justified if the cruelty results in death.

The parameters of bail also change when there is a cruelty component to the physical attack, according to Justice Chitkara, because of the systemic nature of its effects.

In addition, the judge stated that an accused should typically not be granted bail if a court finds that they are guilty of cruel acts prima facie.

However the court later clarified that any mention of ChatGPT does not have any bearing on the case’s merits.
