Supreme Court Launches Guidebook to Combat Gender Stereotypes in Legal Language

New Delhi, August 16, 2023: In a significant step towards promoting gender equality within the legal sphere, the Supreme Court of India has introduced a comprehensive guidebook aimed at eradicating gender biases from court orders and legal language.

The guidebook, unveiled on Wednesday, seeks to empower judges to eliminate inappropriate gender terms and phrases, fostering a more inclusive and impartial legal discourse.

Chief Justice of India DY Chandrachud highlighted the guidebook’s purpose, stating that it is designed to identify and rectify the usage of words and expressions that perpetuate gender biases within court orders and legal documents. By facilitating the identification and avoidance of such biases, the guidebook empowers judges to replace gender-biased language with alternative terms, thus fostering a more equitable legal language.

CJI Chandrachud emphasized, “This resource is intended to aid judges and the legal community in recognizing, comprehending, and challenging stereotypes concerning women in legal discussions. It encompasses a glossary of gender-biased terms and suggests substitute words and phrases that can be employed while drafting pleadings, orders, and judgments. It serves both lawyers and judges.”

The guidebook serves as a tool to confront prevalent gender stereotypes, many of which have been inadvertently incorporated into court proceedings and decisions. By delineating the inaccuracies and distortions these stereotypes introduce to the application of the law, the guidebook raises awareness without criticizing judgments, CJI Chandrachud noted.

The guidebook, available for reference on the Supreme Court’s official website, is accompanied by a tutorial for electronic filing (e-filing) and aims to heighten consciousness about the detrimental impact of stereotypes, particularly those that target women. With this initiative, the Supreme Court reaffirms its commitment to fostering a just and equitable legal environment that respects and upholds gender equality.
