Wary of Growing Misuse Supreme Court Puts Break on Immediate Arrest in Anti-Dowry Law

The apex court of Indian Republic has expressed its concern over growing misuse of Anti-Dowry law and has directed law authorities to do investigation before making arrests under this provision.

Supreme Court of India said, “Many of such complaints are not bonafide and “uncalled for arrest”may ruin the chances of settlement.

A bench of Justice Adarsh Kumar Goel and U U Lalit further added, “We are conscious of the object for which the provision(498 A of the IPC) was brought into the statute. At the same time, violation of human rights of innocent cannot be brushed aside. Certain safeguards against uncalled for arrest or insensitive investigation have been addressed by Supreme court. Still, the problem continues to a great extent”.

People and organizations from all around the country have been raising their voices against growing misuse of Anti-Dowry law. Many false and fabricated cases registered under this clause with an intention of personal grudge or malice has also come to light.

 

Supreme Court has now also asked for constitution of family welfare committees in all districts.
