#AAMAADMIPARTY : ELECTION COMMISSION must register FIR against #AmitShah

The Aam Aadmi Party demands that the Election Commission of India should immediately order registration of a criminal case against the BJP’s national general secretary Mr Amit Shah for his inflammatory remarks aimed at spreading communal hatred.

The highly objectionable remarks of Mr Shah on Thursday at Muzaffarnagar (Uttar Pradesh), which he repeated on Friday and have been widely reported in the media, appear to be a part of his party’s deliberate strategy to vitiate the atmosphere of communal harmony at the time of elections.

According to the AAP, Shah’s utterances, which have not been denied either by him or his party so far, clearly constitute a criminal offence under Section 153 of the Indian Penal Code, and should be booked without any delay.

These remarks are also a clear violation of the Election Commission’s Model Code of Conduct.

The General Conduct for political parties and candidates mentioned in this code states :“No party or candidate shall include in any activity which may aggravate existing differences or create mutual hatred or cause tension between different castes and communities, religious or linguistic.”

The AAP wishes to draw the EC’s attention towards the fact that Mr Shah is currently on bail in a fake encounter case, in which he is facing a trial and was directed by the courts not to enter Gujarat for two years between 2010 and 2012.

It must also be kept in mind that the Gujarat High Court had ordered shifting of the fake encounter trial to Mumbai and the Supreme Court had upheld the decision. An individual, who in his official capacity of minister of state for home, faces charges of having misused the police for masterminding fake encounters, is now spreading communal venom in the society.

The EC should not allow such elements to create hatred at such a sensitive juncture, when the country is in midst of general elections. The remarks openly inciting people of one community to take revenge against another religious community cannot be allowed to go unpunished.

BJP leaders are increasingly trying to stoke communal passions through their utterances. Only recently, its Delhi election campaign incharge, Mr VK Malhotra had named specific areas of the capital and allegedly termed those as terror hubs.

The AAP demands a severe crackdown on such elements who are trying to take advantage of the election period to further their nefarious designs.
