Delhi L-G approves over 300 business applications, allowing businesses to remain open 24/7

New Delhi, 9 October 2022: Delhi LG Saxena has approved the proposal to exempt 314 businesses including restaurants, transportation services, BPOs, and online delivery services to operate around the clock beginning next week.

It is believed that the decision to give exemption under Sections 14, 15, and 16 of the Delhi Shops & Establishment Act, 1954, will lead to more job creation and a more hospitable and supportive business environment, all of which are prerequisites for economic progress. According to one official, the choice will also help the city’s much-desired “night life.”

The L-G has ordered that a notice to that effect be published within seven days. The choice to grant exemption under Sections 14, 15, and 16 of the Delhi Shops & Establishment Act, 1954, is anticipated to increase job creation and foster a favorable and supportive business environment, both of which are necessary conditions for economic growth. The decision will also give the city’s much-desired “night life” a boost, according to one official.

Officials from the L-G office claim that although businesses have submitted requests for exclusions, the Labour Department has not treated them equitably.

In approving the proposal, the LG took a very severe stance and raised concerns about the Labour Department’s excessive delay, adhocism, randomness, and unjustifiable discretion in handling the applications submitted by establishments for these exemptions. It should be noted that the Labor Department failed to process 18 applications from 2016, 26 applications from 2017, 83 applications from 2018, 25 applications from 2019, 4 applications from 2020, and 74 applications from 2021 on time out of the total 346 pending applications, the official stated.

In a show of unexplained discretion on the part of the Labour Department, only 2 applications—one from 2017 and another from 2021—were processed and forwarded for approval, which strongly suggested the prevalence of corrupt acts. This demonstrates the Labour Department’s utter lack of professionalism and diligence, and it amounts to the Department processing such applications according to a “choose and choose policy, they stated.

Officials said that the Labour Department only implemented a computerized system for application receipt after being prodded by the L-G office. In order to foster a climate that is friendly to investors and inspire trust in Delhi’s business sector as a whole, the L-G has firmly suggested that such applications be rejected within a set time frame.

In addition, he further gave the Labour Department instructions to establish a process for transparent and effective monitoring, identify the causes of any delays, assign blame, and take appropriate action against any negligent employees in order to prevent similar delays in the future.
